2 Charged in 2010 Cobb Taxi Killing

A Marietta teenager is accused in the shooting death of a taxi driver at an East Cobb apartment.

A teenager and a man from South Carolina have been charged with the shooting death of a taxi driver at an East Cobb apartment complex in late 2010. 

Javin Rashad Andrews, 17, of Marietta, and James Levone Mitchell, 20, of Columbia, S.C., have been charged with one count each of aggravated assault and homicide, spokesman Sgt. Dana Pierce said in a statement Tuesday afternoon.

Andrews has been in custody at the Cobb County Adult Detention Center on numerous charges since Jan. 12 and Mitchell is awaiting an extradition hearing in South Carolina, Pierce said.

Police said that on Nov. 21, 2010, Ricardo Peter Francois  over the wheel of the Rayo Taxi van he had been driving in a parking lot at the Lincoln Hills Apartments, 3500 Windcliff Drive.

Francois, who was 23 and lived in Powder Springs, had been shot, according to police, who said they received information about the incident last month that led to them obtaining warrants against Andrews and Mitchell.

According to Andrews' booking report with the , he was initially arrested for credit card theft. Andrews later was charged with two counts of burglary and four additional counts of credit card theft before the murder and aggravated assault charges were added this week. 

Cobb Police said Mitchell was arrested Monday without incident by the U.S. Marshals Service and the Richland County (S.C.) Sheriff's Office.
