Lawsuit: WellStar Kennestone Hospital Tossed Stillborn Baby

The hospital has 30 days to respond to the lawsuit in Cobb County State Court.

A WellStar Kennestone Hospital employee allegedly admitted that a stillborn baby was thrown out as medical waste, according to a lawsuit filed today against Marietta hospital.

"It just shocks the conscience and it enrages me as a person," attorney Kevin Adamson told WSB-TV this evening.

Adamson represents the family of the stillborn baby who was delivered in January 2012. The family wanted a private cremation for the baby, but the boy's remains were allegedly taken to Medford-Peden Funeral Home & Creamtory for a mass cremation with other infants, according to WSB. The WellStar employee told the family that the child's ashes were buried under a tree at the funeral home.

"That's a bunch of bull," the funeral home's Pete Peden told the station.

The baby's remains have not been recovered to this day, according to WSB.

WellStar spokeswoman Michelle Robinson said in a statement that the hospital could not comment on pending litigation. The hospital has 30 days to respond to the lawsuit in Cobb County State Court.
